DECLARING A NATIONAL EMERGENCY AT THE SOUTHERN BORDER OF THE UNITED STATES

By the authority vested in me as President by the Constitution and the laws of the United States of America, I hereby proclaim:

America’s sovereignty is under attack.  Our southern border is overrun by cartels, criminal gangs, known terrorists, human traffickers, smugglers, unvetted military-age males from foreign adversaries, and illicit narcotics that harm Americans, including America.
—-
This invasion has caused widespread chaos and suffering in our country over the last 4 years.  It has led to the horrific and inexcusable murders of many innocent American citizens, including women and children, at the hands of illegal aliens.  Foreign criminal gangs and cartels have begun seizing control of parts of cities, attacking our most vulnerable citizens, and terrorizing Americans beyond the control of local law enforcement.  Cartels control vast territories just south of our southern border, effectively controlling who can and cannot travel to the United States from Mexico. Hundreds of thousands of Americans have tragically died from drug overdoses because of the illicit narcotics that have flowed across the southern border.

This assault on the American people and the integrity of America’s sovereign borders represents a grave threat to our Nation.

Because of the gravity and emergency of this present danger and imminent threat, it is necessary for the Armed Forces to take all appropriate action to assist the Department of Homeland Security in obtaining full operational control of the southern border.

To protect the security and safety of United States citizens, to protect each of the States against invasion, and to uphold my duty to take care that the laws be faithfully executed, it is my responsibility as President to ensure that the illegal entry of aliens into the United States via the southern border be immediately and entirely stopped.

As Commander in Chief, I have no more solemn duty than to protect the American people.

NOW, THEREFORE, I, DONALD J. TRUMP, President of the United States of America, by the authority vested in me by the Constitution and the laws of the United States of America, including sections 201 and 301 of the National Emergencies Act (50 U.S.C. 1601 et seq.), hereby declare that a national emergency exists at the southern border of the United States, and that section 12302 of title 10, United States Code, is invoked and made available, according to its terms, to the Secretaries of the military departments concerned, subject to the direction of the Secretary of Defense.  To provide additional authority to the Department of Defense to support the Federal Government’s response to the emergency at the southern border, I hereby declare that this emergency requires use of the Armed Forces and, in accordance with section 301 of the National Emergencies Act (50 U.S.C. 1631), that the construction authority provided in section 2808 of title 10, United States Code, is invoked and made available, according to its terms, to the Secretary of Defense and, at the discretion of the Secretary of Defense, to the Secretaries of the military departments.  I hereby direct as follows:

Section 1.  Deployment of Personnel and Resources.  The Secretary of Defense, or the Secretary of each relevant military department, as appropriate and consistent with applicable law, shall order as many units or members of the Armed Forces, including the Ready Reserve and the National Guard, as the Secretary of Defense determines to be appropriate to support the activities of the Secretary of Homeland Security in obtaining complete operational control of the southern border of the United States.  The Secretary of Defense shall further take all appropriate action to facilitate the operational needs of the Secretary of Homeland Security along the southern border, including through the provision of appropriate detention space, transportation (including aircraft), and other logistics services in support of civilian-controlled law enforcement operations.

Sec. 2.  Additional Physical Barriers.  The Secretaries of Defense and Homeland Security shall immediately take all appropriate action, consistent with law, including 10 U.S.C. 2214, to construct additional physical barriers along the southern border.  To the extent possible, the Secretaries of Defense and Homeland Security shall coordinate with any Governor of a State that is willing to assist with the deployment of any physical infrastructure to improve operational security at the southern border.

Sec. 3.  Unmanned Aerial Systems.  The Secretary of Transportation and the Federal Communications Commission shall, consistent with applicable law, consider waiving all applicable Federal Aviation Administration and Federal Communications Commission regulations or policies, respectively, that restrict the Department of Homeland Security’s ability to counter unmanned aerial systems within 5 miles of the southern border.

Sec. 4.  Revision of Policies and Strategies.  The Secretary of Defense and the Secretary of Homeland Security, in consultation with the Attorney General, shall take all appropriate action, consistent with law, to prioritize the impedance and denial of the unauthorized physical entry of aliens across the southern border of the United States, and to ensure that use of force policies prioritize the safety and security of Department of Homeland Security personnel and of members of the Armed Forces.

Sec. 5.  Revocation.  Proclamation 10142 of January 20, 2021 (Termination of Emergency With Respect to the Southern Border of the United States and Redirection of Funds Diverted to Border Wall Construction), is hereby revoked.

Sec. 6.  Reporting Requirement.  (a)  Within 30 days of the date of this proclamation, the Secretary of Defense shall submit to the President, through the Homeland Security Advisor, a report outlining all actions taken to fulfill the requirements and objectives of this proclamation; and

(b)  Within 90 days of the date of this proclamation, the Secretary of Defense and the Secretary of Homeland Security shall submit a joint report to the President about the conditions at the southern border of the United States and any recommendations regarding additional actions that may be necessary to obtain complete operational control of the southern border, including whether to invoke the Insurrection Act of 1807.

Sec. 7.  General Provisions.  (a)  Nothing in this proclamation shall be construed to impair or otherwise affect:

(i)   the authority granted by law to an executive department or agency, or the head thereof; or

(ii)  the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.

(b)  This proclamation shall be implemented consistent with applicable law and subject to the availability of appropriations.

(c)  This proclamation is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

No one, despite their view of President Trump, can call him “Sleepy Don,” considering how much he has done in his first month in office.

Although I was not an early supporter of Donald Trump, I’ve come to agree with most of his policies, especially those policies that deal with crime and terrorism.

President Trump has issued numerous executive orders rather than push for Congressional legislation. The advantage of an executive order is that it is fast. The disadvantage is the very next president can write executive orders that cancel out the previous president’s executive orders.

Overturning congressional legislation is a much harder task. Congress needs to pass legislation to make immigration and border policies permanent.

But having said that, one can appreciate that President Trump is doing much of what he promised to do in the election.

As Secretary of Homeland Security Kristi Noem noted, “President Trump said from the start: criminal illegals have no place in our homeland. He is keeping his promise.”

The Department of Homeland Security (DHS) issued a “Snapshot of Trump’s First Month: Making America Safe Again” on February 20, 2025.

The DHS statement read, “In a single month, President Trump and Secretary Noem have made massive strides to address the crisis at the southern border and remove violent criminal aliens from American communities. This is just the beginning of the golden age of America.

PROMISES MADE, PROMISES KEPT:

On day one, President Trump declared a national emergency at the southern border and restarted construction of the border wall.

President Trump instantly reinstated “Remain in Mexico” and ended catch and release.    The Trump administration has empowered our brave men and women in ICE, Border Patrol, and Coast Guard to use common sense to do their jobs effectively.

DHS has repealed Biden Era rules that allowed criminal aliens to hide from law enforcement in places like schools and churches to avoid arrest.

DHS returned to using the term “illegal alien” to use statutory language and stop political correctness from hindering law enforcement.

ICE arrests of criminal aliens have doubled and arrests of fugitives at large has tripled.

Daily border encounters have plunged 93% since President Trump took office.

DHS announced earlier on February 17, 2025, that DHS has begun a nationwide and international ad campaign that warns illegal aliens to self-deport.

“Today, Secretary Kristi Noem announced a nationwide and international multimillion-dollar ad campaign warning illegal aliens to leave our country now or face deportation with the inability to return to the United States. The international ads warn criminal illegal aliens not to come to America and break its laws or they will be hunted down and deported.

This series of ads will run on radio, broadcast, and digital, in multiple countries and regions in various dialects. Ads will be hyper-targeted, including through social media, text message and digital to reach illegal immigrants in the interior of the United States, as well as internationally.

As I wrote in a previous piece here, DHS in Philadelphia has caught and deported some very bad guys. They have committed murder, rape and child abuse. These illegal migrant criminals have committed heinous crimes in their own countries and then slivered into America and committed heinous crimes here as well.

GOP senators roll out ‘Wall Act,’ seek to help Trump fulfill his border vision.

Republican senators are fighting to ensure President Trump puts the final touches on the “big, beautiful wall” along the U.S.-Mexico border that he failed to complete during his first term in office.

Sens. James E. Risch of Idaho and Katie Britt of Alabama announced Monday that they were introducing the Wall Act, which sets aside $25 billion to finish construction on the massive barrier.

“Now is the time to finish the southern border wall,” Mr. Risch said. “The WALL Act helps President Trump complete what he started in his first term and does it all without adding a dime to our national debt.”

The lawmakers said the cost of the wall constriction will be offset by “closing loopholes and eliminating taxpayer-funded entitlements and tax benefits for people who are in the U.S. illegally.” It also imposes fines on immigrants who jump the border and those who overstay their visas.

Texas’ border spending exploded after Joe Biden’s election, then state leaders signaled a new willingness to reduce it when Trump won. That didn’t last long..

Days after President Donald Trump was elected back to the White House, Texas’ Republican leaders floated the idea that the state might trim its border security budget, which reached $11 billion over the last four years during the Biden administration.

The Legislature’s lead budget writers have proposed spending another $6.5 billion on border security over the next two years, about what is currently budgeted. And GOP leaders are moving to support the Trump administration’s immigration policies, including mass deportation efforts, far more aggressively than before — even as illegal border crossings remain low.

For the last four years, top Texas Republicans blamed then-President Joe Biden’s “open border policies” for forcing the state to spend billions of state taxpayers’ money to secure the border it shares with Mexico. With Trump back in office, some of the same leaders are ready to continue spending — now to bolster the Trump administration’s promised crackdown on illegal immigration.

“After four years of failed policies, Texas finally has a partner in President Trump,” Gov. Greg Abbott said last week as he directed state police to help federal immigration agents find and arrest immigrants who have arrest warrants. “Together, we will end this crisis and make America safe once again.”

Since Trump took office last month, Abbott has also sent extra state troops to the border, ordered state agencies to work with federal officials on border enforcement and signed an agreement with the Trump administration authorizing Texas National Guard soldiers to make immigration arrests.

Lt. Gov. Dan Patrick — who oversees the state Senate — announced last week that one of his top legislative priorities this session would be requiring local law enforcement to “assist the federal government’s deportation efforts.” Abbott endorsed the idea during his State of the State speech on Sunday, the same day Attorney General Ken Paxton announced he had signed an agreement vowing to “assist with and facilitate” Trump’s mass deportation of undocumented immigrants.

Land Commissioner Dawn Buckingham has also offered Trump a 1,400-acre ranch site in the Rio Grande Valley for the same purpose.

Abbott and Patrick suggested the possible border security spending cutbacks. Patrick did not respond to a request for comment.

“Texas has held the line against the Biden-Harris border crisis for the past four years,” gubernatorial spokesperson Andrew Mahaleris said. “Gov. Abbott looks forward to continuing to work closely with President Trump and his administration to protect our state and the nation.”

Meanwhile, state lawmakers have filed or plan to file bills that would further cement the state’s role in immigration enforcement — which federal law and repeated court rulings has established as a federal responsibility.

“Texas has made a major investment to protect our border,” said state Sen. Pete Flores, a Pleasanton Republican who serves on the Senate Finance Committee. “We’re going to take a more proactive policy stance in maintaining what we’ve gained and holding our position and preserving our border, while the president and the federal government return to their full capacity of doing their job protecting our border.”

To be sure, GOP leaders are also looking at ways to curb Texas’ border spending. Abbott has asked the federal government to reimburse the state for $11 billion spent on border security under Biden. U.S. Sen. John Cornyn is supporting the ask, and Abbott plans to meet with U.S. House and Senate leadership this month to discuss recouping the money, according to the governor’s chief of staff, Robert Black.

Among the biggest state border security expenditures is the $2.3 billion allotted to the Texas Military Department, which oversees the National Guard and its thousands of members deployed to the border under Abbott’s Operation Lone Star initiative. State Sen. Joan Huffman, a Houston Republican who chairs the Senate Finance Committee, noted at a budget hearing last week that if the Trump administration ordered the National Guard to the border, rather than Abbott, the state would no longer be on the hook for paying their salaries. That change alone would save Texas $200 million a month, Huffman said.

Asked by Huffman if there was “any hope” of making that change, Black said he heard “a hot rumor” that Pete Hegseth, the newly confirmed defense secretary, might be coming to Texas soon to discuss the matter with the military department’s leader, Maj. Gen. Thomas Suelzer. Hegseth visited El Paso on Tuesday, his first stop at the border as secretary.

“The governor would love for us to be back down to the [border security spending] levels we were [at] under President Bush and President Obama and even President Trump the first time — the four to 800 million range,” Black said at the Finance Committee hearing, referring to the $800 million lawmakers put toward border security every two years before Biden took office.

If lawmakers go ahead with the $6.5 billion, that would push their six-year border security budget — from August 2021 through August 2027 — to nearly $18 billion.

In contrast, the Legislature budgeted about $3.4 billion for border security over the 14-year span from 2007 — when lawmakers began regularly setting aside state funds for border operations — through 2021, when the spending surge began.

“These opening numbers in the initial budget bills are opening salvos in negotiating positions,” said Jim Henson, director of the Texas Politics Project at UT Austin. “Whether those numbers stay the same or are reduced is going to depend on how relations with the Trump administration unfold.”

In his proposed budget, Abbott recommended that the Legislature “continue its funding of border security until the federal government assumes operational control to keep Texans safe and address this crisis once and for all.”

Regardless of spending, Republican lawmakers have already laid the groundwork for an enduring state role in immigration enforcement through a 2023 law that allows Texas police to arrest people for illegally crossing the Mexico border. The law, known as Senate Bill 4, has been put on pause amid a legal challenge.

Additionally, Texas has a way to go on a project spearheaded by Abbott to build a wall along much of the Texas-Mexico border. Lawmakers have approved some $3 billion for the effort, which so far has yielded dozens of fragmented sections scattered across six counties. State contractors had built 50 miles of wall through November, or 6% of the 805 miles the state has designated for building.

The Legislature also passed a law in 2023 that increases the minimum sentence from two years to 10 years for people convicted of smuggling immigrants or operating a stash house. And Republicans tried to create a new state border policing unit, envisioned as a way to relieve strain on the National Guard, but the measure failed.

State Rep. David Spiller, a Jacksboro Republican who carried SB 4 in the House, said he intends to file the lower chamber’s bill that would require police to help federal immigration authorities — and withhold state grant funds for a year from any law enforcement entity that does not oblige.

Spiller said he is also working on a bill that would require police officers to ask about a person’s immigration status when they detain them. Under current law, police are allowed to ask but Spiller said many don’t.

“We shouldn’t have to spend as much money,” Spiller said about the state’s role at the border. “But we are still going to have to address the ills and the wrongs of the Biden administration.”

Perhaps no community has felt the state’s all-out effort to control the border more than Eagle Pass, where Texas officials took over a municipal park they have yet to return, dropped a buoy barrier in the Rio Grande and built a military base to house the National Guard soldiers deployed to the area.

State Rep. Eddie Morales’ district stretches nine counties along the U.S.-Mexico border from El Paso to Eagle Pass, where he grew up. The third-term Democrat sees a waste of money in some of the state’s border initiatives. He pointed to videos of migrants walking around the state’s floating barrier — which has affected the water flow of the Rio Grande in that area.

Border Wall Construction Restarts in California and Texas

Construction restarted on a border wall near the San Ysidro Land Port of Entry on the U.S.-Mexico border in California on Jan. 22, followed by border wall construction and reinforcement work beginning near El Paso, Texas, on Jan. 31.

President Donald Trump said during his presidential campaign he would finish construction of a border wall that began during his first term. This new work, however, is using funds appropriated and contracts awarded during his first administration.

In California, new wall sections with “anti-climb” features are being built in areas that either never had a barrier or only had older fencing. They are being built using 2018 border wall appropriations and contracts held by contractor Fisher Sand & Gravel. The U.S. Army Corps of Engineers also sent personnel to the area around Friendship Park near the San Ysidro Land Port of Entry where new wall sections have been under construction for nearly two weeks.

President Trump’s national emergency declaration “…directs the Dept. of Homeland Security to take all appropriate action to deploy and construct temporary and permanent physical barriers to ensure complete operational control of the southern border of the United States,” according to CBP.

“CBP is working to close numerous gaps in the existing border barrier in the U.S. Border Patrol’s San Diego Sector,” the spokesperson added. “These projects are in various stages of planning and construction is anticipated to start as early as March 2025.”

Five hundred U.S. Marines and sailors have also been deployed from Camp Pendleton to the southern border to assist in enforcement operations there. In Texas, an estimated 1,500 troops have already arrived at Fort Bliss and will be deployed across the border region from El Paso to Sunland Park, N.M., to join Border Patrol efforts. Secretary of Defense Pete Hegseth and Immigration Czar Tom Homan arrived at Sunland Park on Feb. 3 to inspect the operations.

New sections of the federal border wall in the El Paso sector started construction in the last days of January using 2020 funds that the Biden administration had confirmed would be used for a border wall in 2023 but had not started construction on yet. While Fisher also holds the 2020 federal border wall contract, it’s not yet known which contractors are working on the sections being built near El Paso and crews from the Corps were also deployed to the area with the troops from Fort Bliss.

Any further federal funding for border wall construction not already appropriated would require new legislation from Congress.

Border State Seeks Reimbursement

Texas Gov. Greg Abbott (R) has also asked Congress to reimburse the state $11 billion for what he says would cover both construction of a separate state border wall, acquisition of land and enforcement measures the state took during the Biden years.

“This is part of the ongoing discussions with members of Congress to reimburse Texas for the more than $11 billion spent to secure the border and protect Texans and Americans. Governor Abbott recently spoke with members of the Texas Congressional delegation about a reimbursement and continues working with Congress on the details,” said Andrew Mahaleris, press secretary for Gov. Abbott, in a statement.

Contractors are performing ongoing work on the state border wall separate from the federal wall. As the conflict between U.S. law enforcement and the cartels continues, some New Mexico residents are hopeful that Trump will be successful in finishing the border wall to ensure their safety.

Those who remain hopeful include ranchers Brandy and Russell Johnson, who are living just outside the village of Columbus, New Mexico, on a cattle ranch that borders Chihuahua, Mexico. They say they are eager to see the restart of the border wall construction under the new Trump administration.

The couple recalled to ABC News a time in 2019, during Trump’s first term, when funding came through for new construction on the border wall. The Johnsons fought to be included in the plans, with construction expected to seal up close to 9 miles of the border.

“It’s Oct. 20, 2019, and I received a call today from United States Border Patrol agents advising that we had yet another vehicle drive through,” Russell Johnson said. “This vehicle made its entry through the barbed wire portion of the fence that we share with Mexico. Nobody should have to deal with this kind of activity on their ranch or anywhere for that matter.”

However, the Johnsons, who both have law enforcement backgrounds, never expected to become embroiled in a political conflict over the border.

Months after construction began on their wall section, former President Joe Biden was elected. He promised a more empathetic approach to immigration. By March 2021, he halted the construction project, froze funding, and terminated the emergency declaration made by the first Trump administration along the border.

According to Russell Johnson, a former U.S. Border Patrol agent, all the contractors working on the border wall found themselves in a state of uncertainty. Their equipment had been fully operational, but now the site resembled a ghost town, with all the machinery and materials abandoned.

“It’s probably millions of dollars, considering the amount of steel and what steel costs, it’s probably millions of dollars that’s been sitting there for over four years at this point, that you know, the taxpayer paid for, and it’s just been sitting out there,” Russell Johnson said, referring to the border wall building materials that have been sitting on his property since December 2020.

During the Biden administration, the funding and staffing for the Department of Homeland Security were decreased.

In 2024, a bipartisan border security bill aimed at enhancing resources for the department failed to pass after Trump lobbied Senate Republicans to oppose the bill.

“As the leader of our party, there is zero chance I will support this horrible, open borders betrayal of America,” Trump said at his Nevada rally in 2024. “It’s not going to happen.”

It’s a move that Democrats have criticized as a political stunt.

“This bill would save lives and bring order to the border,” Biden said at State of the Union address in March 2024. “I’m told my predecessor called Republicans in Congress and demanded they block the bill. He viewed it would be a political win for me and a political loser for him.”

The Johnsons believe that limited border patrol agents in the field made them more vulnerable. Additionally, a gap in the border wall, which is less than a mile long, has increased their risk of becoming a target for trafficking.

“It’s one of those deals that if you could take the politics out of it, we could have it fixed overnight,” Russell Johnson said. “And that’s what’s been extremely frustrating to me, is I feel like we’re just a political pawn down here, used by both sides at times, to push one narrative or the other.”

The Johnsons are hopeful that Trump can fulfill his promise to resume construction on the border wall. However, they understand that this requires funding and bipartisan support.

During the Biden administration, migrants entered through these unsecured openings, forcing Texas Governor Greg Abbott to take independent action. In October 2023, Abbott directed the Texas National Guard to construct border barriers along the Texas-New Mexico border to mitigate the influx.

WASHINGTON (AP) — The Trump administration is creating a registry for all people who are in the United States illegally, and those who don’t self-report could face fines or prosecution, immigration officials announced Tuesday.

Everyone who is in the U.S. illegally must register, give fingerprints and provide an address, the Department of Homeland Security said in a statement. It cited a section of the Immigration and Nationality Act — the complex immigration law — as justification for the registration process, which would apply to anyone 14 and older.

The announcement comes as the administration seeks to make good on campaign promises to carry out mass deportations of people in the country illegally and seal the border to future asylum-seekers.
“An alien’s failure to register is a crime that could result in a fine, imprisonment, or both,” the statement said. “For decades, this law has been ignored — not anymore.”

On its website, the U.S. Citizenship and Immigration Service said it would soon create a form and process for registration.

In one of his 10 inauguration day executive orders related to immigration, President Donald Trump initially outlined plans for creating a registry and required that Homeland Security “immediately announce and publicize information about the legal obligation of all previously unregistered aliens in the United States to comply.”

It was not immediately clear how many people living in the country illegally would voluntarily come forward and give the federal government information about who they are and where they’re living. But failure to register would be considered a crime, and the administration has said its initial priority target for deportation is people who’ve committed crimes in the U.S.

The National Immigration Law Center, an immigration advocacy group, said in a posting on its website before the Tuesday night announcement that “the Alien Registration Act of 1940 is the only time the U.S. government carried out a comprehensive campaign to require all noncitizens to register.”

The organization said under that process, people had to go to their local post office to register, and the goal was to identify “potential national security threats broadly characterized as communist or subversive.”

The group warned that the registry was meant to help find potential targets for deportation.
